The 510(k) allows expedited approval based on a new product being a “substantial equivalent” to older hip replacement implants. However, numerous patients have suffered pain and early failure from the DePuy Pinnacle hip replacement. DePuy Synthes has been made aware of the increasing number of patient complaints related to the DePuy Pinnacle, but have not recalled the device or released a warning regarding the possible complications.
