Man Sues Tire Company for $18M after Fatal Rollover Accident

A fatal rollover accident that killed a pregnant woman is now the focus of an $18.3 million lawsuit filed in the Multnomah County Circuit Court. This case, which names Continental Tire The Americas as a defendant, is alleging that the poorly designed tires were directly responsible for causing the fatal rollover accident.

Details of the Collision

According to the complaint for this case, the single-vehicle collision took place on June 22, 2013 when a tire on the Ford Expedition in which the pregnant woman, her husband and son were traveling blew out. In fact, as court documents explain, the tire “experienced a sudden and catastrophic separation of the tread from the tire carcass” because it was allegedly “too old to operate safely.”

This tire failure, which the plaintiffs are alleging stemmed from the poor design of the tire, resulted in the SUV rolling over and:

  • The husband reportedly suffering spine injuries and bone fractures, which have cost at least $14,000 in medical bills to date
  • The son suffering spine injuries and persisting headaches, which have resulted in medical bills exceeding $11,000
  • The husband and son having to witness their wife/mother die from her accident-related injuries at the scene – For this pain and suffering, the plaintiffs are seeking $5 million. An additional $3 million is also being sought for the loss of the unborn baby.

Also named as defendants in this case are the now-closed used car dealership where the family reportedly purchased the Expedition just 12 days prior to the accident, as well as the company (Alignment World) that reportedly serviced the SUV prior to the collision.
